Public contract (offer) for the provision of Bookera services
Version 1.1 · effective from 30 September 2026
This translation is provided for convenience only; the Ukrainian version prevails.
This document is a public offer within the meaning of Articles 633, 641 and 642 of the Civil Code of Ukraine: it is addressed to an indefinite range of persons and, once accepted, is a contract. The Provider is ФОП Бранець Олег Русланович (details are in section 13), and the service is Bookera.
The contract is concluded without signing a paper copy. Any of the following actions is deemed acceptance: registering in the app, creating a booking with a Venue, paying a deposit or prepayment, connecting a Venue to the Platform. By taking any of them, you confirm that you have read the terms and accept them in full.
1. Definitions
- Provider — ФОП Бранець Олег Русланович, the person who provides access to the Bookera Platform.
- Platform — the Bookera app, the public website bookera.app and related services.
- Venue — a salon, barbershop, studio or independent specialist who places their schedule and services on the Platform and directly provides beauty services.
- Client — an individual who uses the Platform to find a Venue and book with it.
- Visit — the provision of a service by the Venue to the Client at an agreed time.
- Deposit — a partial or full prepayment of the Visit price, the amount of which is set by the Venue.
2. Subject of the contract
The Provider gives access to the Platform: to the Venue — to keep a schedule and accept bookings; to the Client — to find a Venue and create a booking. The Provider also, on the Venue’s instructions, accepts a Deposit from the Client on behalf of the Venue.
The services are provided remotely, in the territory of Ukraine. The language of the contract is Ukrainian.
3. Two different services and two different parties
Two money flows that differ in substance pass through Bookera. Separating them in the contract is essential: in the first, the Provider sells its own service; in the second, it only accepts funds on behalf of another person.
3.1. The Provider’s service to the Venue is access to the Platform. This is the Provider’s own service, and it is for this service that the Venue pays a fee as set out in section 5 (commissions 5.2.1–5.2.4, the “Team” package, service SMS). Basic access is Bookings, calendar, clients and chat, as well as a deposit and prepayment for a visit. There is no subscription fee for this basic access. Basic access includes 1 specialist per venue.
3.2. The Provider’s service to the Client is the technical ability to find a Venue, see free time and create a booking. The Provider does not provide beauty services, has no specialists and is not the performer of the visit. The beauty service is provided by the Venue, which determines its content, price and duration and is responsible for its quality and safety.
3.3. A deposit and prepayment for a visit are part of basic access and require no separate subscription fee. If the Venue requires a deposit, the Provider accepts it from the Client as a commercial agent — on behalf of the Venue and on its instructions. These funds are not the Provider’s income: they belong to the Venue from the moment of payment and are transferred to it less the Provider’s fee under section 5. The Provider does not acquire ownership of the beauty service and does not resell it.
3.4. The consequences that follow from 3.3 and to which the Client agrees: the settlement document for the beauty service is issued by the Venue; warranty and consumer claims about the service are addressed to the Venue; the Provider is responsible for the operation of the Platform and for the correct acceptance, refund and transfer of funds, not for the result of the visit.
The Provider is not a financial institution, does not provide payment services and does not carry out money transfers as a separate service. Payments are accepted by the LiqPay payment service (JSC CB “PrivatBank”) under a separate contract with the Provider.
4. How a booking is created and confirmed
The Client chooses a Venue, a service, a specialist (if the Venue offers that choice), a date and a time from the free slots in the Venue’s schedule. The price and duration are shown by the Platform from the data the Venue published itself.
A Client’s first booking with a particular Venue may require confirmation by the Venue — the Client then sees the status “awaiting confirmation”. Repeat bookings with the same Venue are confirmed automatically. The Venue has the right to refuse to confirm a booking; in that case the paid Deposit is refunded in full.
Before the booking is confirmed, the Client sees the final amount payable, the Deposit amount (if any) and the cancellation terms. The amounts shown on the confirmation screen are the ones that apply: they are fixed in the booking and are not recalculated later.
5. Price of the services and payment procedure
5.1. The price of the beauty service is set by the Venue. The Provider does not change it, adds no mark-up to it and does not charge the Client for using the Platform: the Platform is free for the Client.
5.2. There is no subscription fee for basic access (Bookings, calendar, clients and chat, deposit and prepayment, 1 specialist). The Provider’s fee is a percentage of completed visits (the rates are in 5.2.1–5.2.4), withheld from the amount transferred to the Venue through the Platform; if the payment did not go through the Platform, an invoice is issued.
5.2.1. The fee for a new client brought in by the Platform (the Discover feed, search, the Eve assistant) is 10 % of the service price of that client’s first attended visit at that Venue. Cancellations and no-shows create no fee. Tips are not part of this base. A repeat visit at the same Venue is 0 %. A client whom the Venue added itself, or who came via the Venue’s link or QR code, does not give rise to this fee.
5.2.2. If the Client pays by card through the app, the Provider’s fee is 1 % of that service payment plus the actual fee of the LiqPay payment service. Both amounts are shown as separate lines in the settlement with the Venue. 1 % is not withheld from tips paid by card. The Client is not charged any extra fee for paying online.
5.2.3. Boost is 20 % of the service price of an attended new visit, if the Venue itself switched Boost on before the booking was created. Boost is off by default. It is switched on by the owner of the Venue.
5.2.4. Pay-per-click advertising is switched on by the Venue separately. The daily budget is set by the Venue. It is off by default. No charge is made for impressions. It is switched on by the owner of the Venue.
5.2.5. “Team” package — 999 ₴ per month per venue. It is needed for the venue to have more than 1 specialist. A new venue gets this package for 14 days without this fee. Basic access under clause 5.2 does not depend on this fee. The package is switched on by the owner of the Venue. A specialist does not buy the package. Until the date payment opens, the package cannot be bought: Payment will open later. The Venue is notified of that date.
5.2.6. The fee under clauses 5.2.1–5.2.5 and 5.2.7 is withheld from amounts transferred to the Venue, if that payment goes through the Platform. If a fee has arisen but there is no amount to withhold it from through the Platform, the Provider issues an invoice to the Venue.
5.2.7. Service SMS (visit reminders and booking confirmations) — 1.50 ₴ per message. Paid by the Venue. Push notifications carry no such charge. The account sign-in code is not priced under this clause.
5.2.8. The specialist limit under clause 5.2 and the charges for the “Team” package and service SMS apply from the date payment opens, of which the Venue is notified. A Venue that is already using the features of the “Team” package or service SMS when this version takes effect gets them without this charge for 6 months from that date payment opens.
5.3. The Deposit is paid by payment card through the LiqPay payment service. The Client enters the card details on the payment service’s side; the Platform does not receive or store them. If the Client saves the card for future payments, the Platform stores only the payment service token and the masked number (a few first and last digits).
5.4. No additional fee for paying online is charged to the Client. The price shown before confirmation is final.
5.5. The rest of the Visit price (that is, the amount above the Deposit) is paid by the Client to the Venue directly, in the manner the Venue determines itself.
6. Obligations of the parties
The Client undertakes:
- to provide a genuine phone number and name — the Venue identifies the booking by them;
- to come at the booked time or to cancel the booking in advance;
- not to use the Platform for actions prohibited by law and not to create bookings without intending to visit the Venue.
The Venue undertakes:
- to publish accurate data about its services, prices, duration, address and opening hours;
- to provide the service at the confirmed time and to the stated extent;
- to hold all permits and documents required for its activity under the laws of Ukraine;
- to fulfil, on its own, the obligations of a service seller towards the consumer, in particular regarding settlement documents and handling quality claims.
The Provider undertakes:
- to ensure the operation of the Platform and access to it;
- to pass Clients’ bookings to the Venue without changing their terms;
- to accept, refund and transfer funds in the manner described in this contract;
- to process personal data in accordance with the Privacy Policy.
7. Cancelling and rescheduling a booking
A booking can be cancelled or rescheduled in the app at any time before the visit starts. The free cancellation window is set by the Venue: it lasts from 2 to 48 hours before the visit starts, and if the Venue has not changed it — 3 hours.
The window that applies is the one shown to you when the booking was created. If the Venue later changes its settings, this does not affect bookings already made: the window is fixed in the booking itself at the moment of booking.
Cancelling after the free window is also allowed — it is not blocked, but it is noted in your visit history. Late cancellation has financial consequences only in the case described below.
8. Deposit refunds
A deposit is the Venue’s money that Bookera accepted on its behalf. The service itself initiates the refund automatically, without a separate request from you, in the following cases:
- the Venue cancelled your visit — the deposit is refunded in full regardless of when it was cancelled;
- you cancelled the visit within the free window — the deposit is refunded in full;
- you cancelled the visit later or did not come, and the Venue had not published retention terms and had not shown them to you before the booking was confirmed — the deposit is refunded in full;
- the booking was not confirmed because the payment was not completed — no money was charged, so there is nothing to refund.
If the Venue published retention terms and showed them to you before the booking was confirmed, exactly the amount in hryvnias that you saw on the confirmation screen is retained, not a percentage calculated later. The rest of the deposit is refunded automatically. It is impossible to retain more than you actually paid.
As of the date of this version, no Venue has published retention terms, so in practice the deposit is refunded in full in all the cases listed.
The refund is made by the same method used for the payment — to the same payment card. Bookera sends the refund instruction to the payment service on the same day; the time it takes for the money to reach the card is determined by the bank that issued it: usually up to 5 banking days, and at most up to 30 calendar days under the rules of the payment systems.
9. Unfinished payment
If the Venue requires an online prepayment before the booking is confirmed, you have limited time to pay. It is set by the Venue within 15 to 120 minutes; if the Venue has not changed this period — 30 minutes. You see the exact period when booking, the free slot in the schedule is held for you for exactly that time, and you see the countdown in the app.
When the countdown ends, the server cancels the booking with the reason “payment not completed”, and the payment page stops working. No money is charged. You can book again straight away if the time in the schedule is still free.
If the payment still went through after the booking was cancelled (for example, it arrived with a delay), the money is refunded automatically: no payment is left without a booking.
10. If something went wrong
Write to [email protected] — give the phone number you use Bookera with, the name of the Venue, the date of the visit and the amount. We reply within 14 calendar days, and if the reply needs data from the Venue, we tell you so within the same period.
Claims about the beauty service itself — its quality, duration, result — are handled by the Venue that provided the service: it is the performer of that service and a party to the corresponding contract. Bookera assists with communication and provides data about the booking and the payment, but does not assess the quality of the specialist’s work.
11. Liability and its limits
11.1. Liability for the beauty service — its quality, safety, conformity with the description and timing — lies with the Venue as its performer. The Provider is not a party to these obligations and does not guarantee the result of the Visit.
11.2. The Provider is responsible for the operation of the Platform and for the correctness of transactions with funds: accepting the Deposit, refunding it in the cases set out in section 8 and transferring it to the Venue. The Provider is not liable for technical failures caused by reasons beyond its control (unavailability of the payment service, the telecom operator or the network), but must refund the money if the Visit did not take place because of the failure.
11.3. The Platform is provided in the condition it is in at the time of use. The Provider does not guarantee uninterrupted operation but strives to remove interruptions without undue delay.
11.4. Nothing in this contract limits the Client’s rights as a consumer provided by the Law of Ukraine “On Consumer Rights Protection” and other provisions of the laws of Ukraine.
12. Personal data, artificial intelligence and term
12.1. The procedure for processing personal data, the list of processors and the rights of the data subject are described in the Privacy Policy (/en/privacy), which is an integral part of this contract.
12.2. Some Platform features are based on artificial intelligence: hints and consultations of the EVE assistant, drafts and automatic replies of the Venue. Messages generated by artificial intelligence are labelled as such. EVE’s advice is for reference only and is not a medical consultation or diagnosis.
12.3. The contract is valid from the date stated at the beginning of the document until it is replaced by a new version. The Provider has the right to change the terms; it gives notice of material changes no later than 14 calendar days before they take effect by publishing the new version on the website. The terms of a booking created before the new version takes effect do not change.
12.4. Disputes not resolved by correspondence are considered under the laws of Ukraine.
